KVKK Privacy Notice

This privacy notice has been prepared, pursuant to Article 10 of the Personal Data Protection Law No. 6698 ("KVKK"), by Op. Dr. Zafer Atakan in the capacity of data controller, in order to inform you about the processing of your personal data.

2. Categories of Personal Data Processed

The following categories of personal data may be processed by us:

Identity Information: Name, surname, Turkish ID number, date of birth, gender.

Health Information (Special Category Personal Data): Medical history, medications used, allergies, examination and treatment records, before/after photographs, diagnosis and treatment information.
Visual and Audio Recordings: Photographs, videos and promotional images (only if you have given explicit consent).
Customer Transaction Information: Appointment records, treatment history, request and complaint records.
Transaction Security Information: IP address, cookie records, website usage data.

3. Purposes of Processing Personal Data

Your personal data is processed for the following purposes:

Planning and delivering healthcare services, including aesthetic surgery and related healthcare services,
Assessing patients/clients and managing diagnosis and treatment processes,
Scheduling appointments and carrying out communication activities,
Fulfilling legal obligations and ensuring regulatory compliance,
Evaluating and responding to requests and complaints,
Improving service quality and managing satisfaction processes,
Using visual content for promotional and informational purposes, if you have given explicit consent,
Operating the website and ensuring its security.

4. Legal Grounds for Processing Personal Data

Your personal data is processed on the basis of the following legal grounds set out in Articles 5 and 6 of the KVKK:

It is expressly provided for by law,
It is directly related to the establishment or performance of a contract,
It is necessary for the data controller to fulfill its legal obligations,
It is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject,
With regard to health data, processing by persons under an obligation of confidentiality for the purposes of protecting public health, preventive medicine, medical diagnosis, and the provision of treatment and care services, or your explicit consent.

5. Method of Collecting Personal Data

Your personal data is collected by automated or non-automated means through forms on the website, appointment requests, phone, e-mail, social media channels, and consultations and treatments carried out face to face at the clinic.

6. Transfer of Personal Data

Your personal data may be transferred to the following parties, limited to the purposes stated above and within the conditions set out in Articles 8 and 9 of the KVKK:

Legally authorized public institutions and organizations (Ministry of Health, judicial authorities, etc.),
Suppliers, laboratories and business partners we work with to deliver our services,
Parties from whom IT, accounting, legal and consultancy services are obtained.

Your personal data is not transferred abroad without your explicit consent.

7. Your Rights as a Data Subject

Pursuant to Article 11 of the KVKK, you have the following rights by applying to the data controller:

To learn whether your personal data is processed,
To request information about it if it has been processed,
To learn the purpose of processing and whether the data is used in line with that purpose,
To know the third parties to whom your data is transferred in Turkey or abroad,
To request the correction of your data if it has been processed incompletely or inaccurately,
To request the erasure or destruction of your data within the framework of the conditions set out in the KVKK,
To request that correction, erasure and destruction operations be notified to third parties to whom the data has been transferred,
To object to a result arising against you from the analysis of the processed data exclusively through automated systems,
To claim compensation for damages if you suffer loss due to unlawful processing.

8. Application Method

You may submit your requests regarding the rights listed above to the data controller, together with documents proving your identity, using the following methods:

Your applications will be concluded free of charge within thirty (30) days at the latest, depending on the nature of the request. However, if the process requires an additional cost, a fee may be charged in accordance with the tariff set by the Personal Data Protection Board.

9. Changes

This privacy notice may be updated in line with changes in legislation and clinical practice. The current version takes effect on the date it is published on our website.
